State Engineer Adopts Rules and Regulations for Active Water Resource Management (effective date December 30, 2004)
 In response to continuing drought in New Mexico, general rules and regulations for administering Active Water Resource Management (AWRM) were finalized by the State Engineer on December 3, 2004. The drought highlights the need for the State Engineer to be actively engaged in the field to administer the actual use of water.

These statewide rules and regulations provide that, when necessary, junior water rights that would otherwise be curtailed will be able to temporarily acquire senior water rights from owners participating in the water rights marketplace in an expedited manner. The rules and regulations were made public in June and were revised as appropriate in response to public comments. The revised draft was made public at a meeting at the State Capitol Building in Santa Fe on October 13.

 On August 17, 2004 the New Mexico Interstate Stream Commission adopted final weather modification regulations after considering testimony given at the July 20, 2004, public rule making hearing.

Surface Water Administration Rules and Regulations
 State Engineer Adopts Rules and Regulations for Surface Water Administration (effective date January 31, 2005): Revised rules and regulations for Surface Water Administering were adopted by the State Engineer on January 31, 2005. The rules and regulations were made public in May, went to hearing in Santa Fe on June 21, 2004, and were revised as appropriate in response to public comments.

Dam Safety Rules and Regulations
  The State Engineer adopted the Dam Design, Construction and Dam Safety Rules and Regulations on March 9, 2005 with an effective date of March 31, 2005. The rules and regulations were made public in May 2004, went to hearing on June 24, 2004 and were revised as appropriate in response to comments.
